These Terms of Use ("Terms") govern your use of Swipe: Swipe Photo Cleaner ("Swipe" or the "App"), operated by Brievo LLC ("we," "us," or "our").

By downloading or using the App, you agree to these Terms.

1. Description of the Service

Swipe is a photo organization tool that allows users to: review photos and videos; swipe to keep, save, or queue for deletion; view insights and statistics; permanently delete photos from their device; and subscribe to Swipe Plus for additional features.

Swipe does not store your photos externally.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the App. By using Swipe, you represent that you meet this requirement.

3. User Responsibilities

You agree to:

Use the App lawfully
Ensure you have backups of important photos before deletion
Understand that permanent deletion cannot be undone by the App

We strongly recommend backing up your Photos library (e.g., via iCloud or local backup) before bulk deletion.

4. Permanent Deletion Disclaimer

When you confirm deletion, photos are permanently deleted through Apple's Photos framework. Swipe cannot recover deleted photos. You acknowledge that you are solely responsible for deletion decisions.

5. Subscriptions (Swipe Plus)

Swipe offers optional auto-renewing subscriptions:

Weekly
Monthly
Annual

Billing

Payment is charged to your Apple ID at confirmation.
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
You can manage or cancel subscriptions in your Apple Account Settings.
Refunds are handled by Apple according to App Store policies.
Swipe does not directly process payments.

6. Free Tier Limits

Free users are limited to:

50 keep actions per day
50 save actions per day
50 queue-for-delete actions per day
50 Delete Bin actions per day

Limits may change in future updates.

7. Intellectual Property

All app design, branding, content, interface elements, and software are the property of Brievo LLC. You may not:

Reverse engineer the App
Copy or redistribute the software
Use branding without permission

8. Disclaimer of Warranties

The App is provided "as is" and "as available." We do not guarantee: error-free operation, uninterrupted service, or compatibility with all devices. You use the App at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Brievo LLC shall not be liable for: data loss, photo deletion, device damage, indirect or consequential damages, or subscription billing disputes handled by Apple. Your sole remedy is to stop using the App.

10. Termination

We may suspend or terminate access if you violate these Terms. You may stop using the App at any time by deleting it.

11. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of updated Terms.
